Terms of Use

These Terms of Use ("Terms") form a binding legal agreement between you and the operators of Chupke Chat. By downloading, installing, accessing or using Chupke (the "Service") you accept these Terms, our Privacy Policy, and our community guidelines. If you do not agree, stop using the Service.

You must be at least 18 years old and legally competent to enter a binding contract under the Indian Contract Act, 1872. We reserve the right to terminate any account we reasonably believe belongs to a minor and to report suspected minor activity to authorities.

Accounts are anonymous and cryptographically tied to your device. You are solely responsible for activity under your account. Your recovery code is the only way to restore access; we do not store, cannot recover and are not liable for lost codes.

You agree that you will NOT use the Service to:

• Harass, threaten, dox, stalk, defame, blackmail or bully any person.
• Post, request or transmit any content that sexualises or depicts a minor (CSAM/CSAE) — this is a criminal offence and is reported to authorities.
• Solicit or share nudity, sexual services or sexually explicit material.
• Promote violence, terrorism, self-harm, or hatred against any individual or group on grounds of religion, caste, gender, orientation, ethnicity or nationality.
• Post content that is obscene, paedophilic, invasive of privacy, libellous or otherwise contrary to Indian law (Rule 3(1)(b), IT Rules 2021).
• Sell illegal goods, controlled substances, weapons, counterfeits or fraudulent services.
• Impersonate any person, brand or official.
• Send spam, scams, phishing, malware or unauthorised advertising.
• Deanonymise, unmask or extract personal information about other users.
• Bypass, disable or reverse-engineer any safety or security feature.
• Use bots, scripts or emulators.
• Violate Indian law including the IT Act 2000, Bharatiya Nyaya Sanhita 2023, POCSO Act 2012, or the Indecent Representation of Women (Prohibition) Act 1986.

Violations may result in immediate permanent termination and disclosure of information to law-enforcement.

All User Content is created by users, not by us. You are solely responsible for your User Content. You grant us a worldwide, royalty-free, non-exclusive licence to host, transmit, store, moderate, analyse and remove your User Content to operate and secure the Service and comply with law.

Chupke is an "intermediary" within Section 2(1)(w) of the IT Act, 2000 and claims the protection of Section 79 and the safe-harbour provisions applicable to intermediaries.

We use automated filters, ML classifiers and human review. We may remove content, restrict features, suspend or permanently ban any account or device, and share information with authorities at our sole discretion where we in good faith believe it necessary to comply with law, protect users or prevent harm.

Every chat and profile includes a Report button. Reports are reviewed within 24 hours. For emergencies dial 112. We cooperate with valid legal process and may preserve, access and disclose account information, IP addresses and message logs.

Chupke has zero tolerance for CSAE. Confirmed CSAE content is removed, the account permanently banned, device fingerprints blocked, and content and account information reported to NCMEC (where applicable) and Indian law-enforcement under POCSO 2012 and the IT Act 2000.

The Service, software, design, trademarks, logos and the name "Chupke" are owned by us or our licensors. You receive a limited, personal, non-exclusive, non-transferable, revocable licence for personal, non-commercial use.

The Service uses Google AdMob, Google Firebase and Supabase. Your use of these services is subject to their own terms and privacy policies. We are not liable for any advertiser or third-party transaction.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THE CONDUCT, IDENTITY, AGE OR SAFETY OF ANY USER. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHUPKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED INR 1,000.

You agree to defend, indemnify and hold harmless Chupke from any claims arising out of your use of the Service, your User Content, or your violation of these Terms or any law.

The Service enables anonymous communication with strangers. Users may act inappropriately despite our safeguards. You assume all risks associated with interacting with other users.

You may delete your account at any time. We may suspend or terminate accounts with or without cause and without notice. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of the Republic of India. Subject to Section 17, the courts at Kapurthala, Punjab, India shall have exclusive jurisdiction.

Disputes shall first be attempted amicably by written notice. If unresolved within 30 days, they shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by us. Seat and venue: Phagwara, Punjab, India. Language: English. Disputes may only be brought in your individual capacity.

We are not liable for delays caused by circumstances beyond our reasonable control including acts of God, war, government action, outages or third-party failures.

If any provision is held invalid, the remaining provisions remain in full force. These Terms and the Privacy Policy constitute the entire agreement.
